Local business sues to stop construction in Marion Square Plaza - KCRG

CEDAR RAPIDS, Iowa (KCRG) - The owner of Reliable Iowa Construction (RIC Flooring) in Marion is suing to stop a new downtown construction project near his business.

Jason Potts chose to build his flooring store in Marion Square Plaza located at 1101 Seventh Avenue in Marion because he was promised the property management company would renovate the property. But, said those plans have changed and is now suing to stop construction unless it is the original plans are performed.

He said his biggest concern is with potential construction and condos being installed.

The 19-page lawsuit is filed against Genesis Equities, LLC, Eagle View Partners LC, Marion Economic Development Co., and Uptown Holdings LLC. The lawsuit also alleges the property was not maintained properly.

Mike Dee, who is a lawyer for the defendants said, they are committed to finding a solution.

“Our clients remain committed to finding a solution that serves both RIC Flooring and the greater Marion community. he said.” “We hope and expect this project will be a positive step forward for Uptown Marion, especially after the devastation caused by coronavirus and derecho. We remain committed to accommodating Mr. Potts and all of the surrounding businesses through this transition.”
