A truck stop is no longer planned for a controversial site just west of Loop 303 in Glendale.
The owner of the property, between Bethany Home Road and Glendale Avenue, canceled its sales agreement with Love's Travel Stops, and has agreed to restrict the use of the land to prevent a truck stop from being built, Glendale announced Friday.
The decision comes after people living nearby hired an attorney and started to gather signatures to try to place a referendum on the city's ballot to reverse the rezoning of the land that would have allowed for the truck stop.
The Glendale City Council voted in June to rezone the land. It was the final city approval needed for the truck stop to be built there.
The land owner has now entered into a deed restriction agreement with the Montana Farms Property Owners Association and Protect Neighborhoods Now to prohibit a truck stop from being built there, according to the city.
A representative for the land owner didn't immediately return an email asking if the referendum effort played a part in the decision to cancel the contract and restrict the land's use.
Dozens of residents living nearby had made it clear to the council in the months leading up to the vote that they did not want the truck stop, saying it would pose health and safety risks to their community.
Kathryn McKinney, who helped organize the referendum effort against the truck stop, said she thought it hurt the effort to sell the land.
"I think we all will feel much safer knowing that the truck stop is not here," McKinney said. "From the outcry I heard from our residents, they were all very happy about it. We all feel blessed we had a good community to come together and work together to make that happen."
McKinney helped start a GoFundMe that raised more than $5,000 to pay for the legal fees related to the referendum effort.
Love's had told the council previously that the company had considered several locations along Loop 303 for the truck stop.
On Friday, Love's spokesperson Chad Previch said the company doesn't currently have plans to build a truck stop at another location in Glendale or along Loop 303.
The City Council voted 6-1 for the rezoning last month. Vice Mayor Ray Malnar was the lone "no" vote.
Councilwoman Joyce Clark, who represents the district that includes the rezoned land, voted for the rezoning.
In the city announcement issued Friday, Clark thanked the owners of the land for their communication throughout the process.
“I appreciate their patience and willingness to listen to the many different voices in our community," she said.
She said she is "fully committed to doing everything" within her power to see that the land owner is successful in developing the land, which will bring economic growth, revenue and job opportunities to the city.
