Gov. Brad Little and Idaho Attorney General Lawrence Wasden filed a lawsuit Monday in an attempt to remove an encampment of protesters across from the Capitol building, according to a press release from the governor’s office.
Little has asked the Idaho Department of Administration to seek an injunction on behalf of the state barring individuals from camping on state property near the Capitol, according to the release. A number of tents have been set up in the area since mid-January to call attention to a lack of affordable housing across the state and a shortage of emergency shelter beds. The protest is driven in part by members of a group called Boise Mutual Aid.
“What started here as a gathering of loosely affiliated individuals has escalated into dangerous health and safety violations,” Little said in the release. “This lawsuit is the next step in our deliberate, careful strategy to address a highly complex situation involving state statutes, case law, and the First Amendment while ensuring the state meets its obligation to protect public health and safety.”
According to the release, Central District Health has inspected the area and deemed it a public health and safety hazard. Idaho State Police has visited the site many times and made arrests, and has seized items from protesters such as sleeping bags, propane tanks, pillows and drug paraphernalia, according to reporting from the Associated Press.
Little said the protest is unnecessary because there are open beds at the Boise Rescue Mission, according to Rev. Bill Roscoe.
